According to the Seoul Central District Court, Kim Shin Il claimed that “They plagiarized “To My Man” from ASH’s 2nd album.” Since J.Y. Park was the songwriter and lyricist of “Someday”, he is being sued for 110 million won ($103,000 USD) for compensation.
Kim Shin Il’s manager claimed,
“The melody of the chorus of ‘Someday’ is like ‘To My Man’, which was composed in 2003.
The harmony and rhythm, the acoustic guitar and drums, even the bass, the instruments are all similar too.
…We demand 110 million won to compensate for the losses due to copyright infringement.
Mr. Park has plagarized on several occasions in the past, and called them ’samplings’ and ‘arrangements’. J.Y. Park’s ‘Kiss Me‘ from his 5th album and g.o.d’s ‘To My Mother‘ and ‘Observe‘ have been given up.“
On July 12th, J.Y. Park’s representative responded saying,
“Regretfully, we will abide by the law. It can’t be said that it’s plagarism since it has a chord progression that is commonly used in popular music.
If they sue, we will take action with a legal team.”
